Prize Delivery, Site Requirements and Winner Responsibilities
Sponsor will arrange and pay for standard ground freight of the prize from the Prize Provider's facility to one (1) delivery address designated by the verified winner, located within the forty eight (48) contiguous United States or the District of Columbia, up to a maximum freight contribution of Two Thousand Five Hundred Dollars ($2,500.00).
If the actual freight cost to the winner's designated address exceeds that amount, the winner may: (a) pay the difference directly to the carrier; or (b) designate an alternate delivery address that falls within the freight contribution. Sponsor will obtain freight quotations from carriers of its choosing and Sponsor's quotation is final and binding.
Delivery is ground level only, to a single commercially accessible address. The prize will be tendered on a flatbed or similar over the road trailer, which is not equipped to unload it. The winner is solely responsible, at the winner's own cost, for offloading the prize from the carrier's trailer, for supplying any forklift, loader, crane, roll off truck or other equipment required to do so, and for any standby, detention or redelivery charges incurred if the winner is not ready to receive and offload the prize at the scheduled delivery appointment.
Before the prize ships, the winner must confirm to Sponsor in writing, with photographs if Sponsor requests them, that the delivery site provides at minimum: approximately sixty (60) feet of straight line vehicle access; ten (10) to twelve (12) feet of width; twenty three (23) feet of overhead clearance; and a level, stable, load bearing surface able to support a container weighing approximately six thousand (6,000) pounds when empty.
If the winner cannot provide a conforming site within fourteen (14) days of notification, or if the carrier determines on arrival that the site is not safely accessible, the winner may designate a conforming alternate address at the winner's own cost, or forfeit the prize, in which case an alternate winner may be selected.
The winner is solely responsible for obtaining and paying for every permit or approval required by any municipality, county, homeowners association, landlord or property owner in order to place, store or use the prize, and for all associated fees. The winner is advised to confirm that placement is lawful at the intended site before accepting delivery, and to notify the winner's insurer before taking delivery.
Title to and risk of loss of the prize pass to the winner upon delivery to the designated address.
THE PRIZE IS AWARDED "AS IS", WITH ALL FAULTS, AND SPONSOR MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Any warranty applicable to the prize is that of MAC Corporation alone, to the extent one is offered by MAC Corporation.
The winner is solely responsible for all costs, taxes, permits and obligations associated with the prize that are not expressly stated above, including without limitation: all federal, state and local taxes on the value of the prize; any sales, use, excise or similar charge; site preparation and surface protection; any damage to pavement, landscaping, structures or utilities caused by the delivery, placement, use, relocation or removal of the prize; insuring the prize and any liability arising from it; and all subsequent transport, relocation, storage and disposal.
Substitution. Sponsor reserves the right to substitute a prize of equal or greater value if the prize becomes unavailable for any reason. No substitution, transfer, assignment or cash equivalent is permitted, and no cash alternative to the prize will be offered or awarded. The right to receive the prize is non transferable and non assignable.
Delivery will be arranged within approximately six (6) to ten (10) weeks after the winner returns all required documentation. Sponsor is not responsible for any delay in delivery, or for any failure to deliver, caused by events beyond its reasonable control, including carrier delay, equipment or material shortage, weather, labour action, or any act of government.
